1. About Kada Travel

MULTISERVICIOS KADA EIRL is a licensed luxury travel company registered in Lima, Peru, operating under Peruvian tourism law. We specialise in bespoke private journeys across Peru and South America, working with a carefully curated network of hotels, local guides, transport operators and specialist lodges. By confirming a booking with Kada Travel, you agree to be bound by these terms and conditions in full. These terms apply to all travellers included in a booking. If you make a booking on behalf of others, you confirm that you have their authority to do so and that each traveller has been informed of and accepts these conditions.

2. General Conditions

Travel Insurance: Comprehensive travel insurance is required for all journeys that include active, adventure or high-altitude components, and is strongly recommended for all other trips. Your policy should cover trip cancellation, emergency medical care, evacuation, baggage loss and repatriation. Kada Travel accepts no liability for any loss that a suitable insurance policy would have covered. Passports, Visas and Entry Requirements: It is each traveller's sole responsibility to ensure that all passports, visas, travel permits, health certificates and vaccination records are valid and obtained before departure. Any costs arising from failure to meet entry requirements are the traveller's responsibility. Visa requirements vary by nationality and change frequently -- we recommend consulting the relevant embassy or consulate well in advance of booking. Inca Trail and Permit-Controlled Sites: Permits for the Inca Trail and other protected sites in Peru are strictly limited in number and must be reserved in advance. To secure your permit, complete and accurate personal information -- your full name exactly as it appears on your passport, passport number and date of birth -- must be provided promptly upon our request. Kada Travel accepts no responsibility for failure to secure permits due to late or incorrect information provided by the traveller. Inca Trail permits are non-refundable and non-transferable under any circumstances. Inherent Risk: Travelling in Peru and South America involves activities and environments that carry inherent risk, including high altitude, remote and wilderness locations, river travel, trekking and wildlife. By booking with Kada Travel, you accept these risks. We are not liable for any illness, injury or fatality arising from participation in any activity during your journey. We strongly encourage you to seek medical advice before departure, particularly regarding altitude sickness. Complaints During Travel: If you are unhappy with any aspect of the service during your journey, you must notify your Kada Travel representative or guide immediately so that we may work to resolve the issue at the time. Refunds or compensation will not be considered for complaints raised only after the trip has concluded, unless Kada Travel was notified and given a reasonable opportunity to address the matter during the journey.

3. Booking and Confirmation

A booking is considered confirmed only upon receipt of a completed and signed booking form (or written email acceptance) together with the required deposit. Kada Travel will then issue a written itinerary and payment schedule. Draft itineraries, indicative quotes and verbal discussions do not constitute a confirmed booking. In some cases, an advance planning retainer of US$250 may be requested to cover initial research and itinerary design services before a formal booking is placed. This amount is fully transferable against the final cost of the journey. It is at the discretion of Kada Travel to determine in which cases this retainer applies.

4. Payment Schedule -- Individual Journeys (1 to 7 Rooms)

A non-refundable deposit of US$1,000 per person is required at the time of booking. This covers initial travel planning and design services, as well as any vendor expenses required to secure your arrangements, including entrance fees, Inca Trail permits, train reservations, internal flights and specific property bookings. The balance is due no later than 60 days before the departure date. If full payment is not received by this deadline, Kada Travel reserves the right to release reservations without further notice; we will advise you in advance if this is at risk. Bookings confirmed within 60 days of departure require full payment upon confirmation. Bookings that include Amazon river cruises and are confirmed 95 days or fewer before departure require full, non-refundable payment at the time of booking. All amounts are quoted in US dollars unless otherwise stated.

5. Payment Schedule -- Group Journeys (8 Rooms or More)

A non-refundable deposit of US$2,000 per person is required at the time of booking, covering initial travel planning services and vendor commitments necessary to hold your reservations. The balance must be received no later than 75 days before the departure date. If full payment is not received by this deadline, reservations may be released without further notice. Kada Travel must receive a confirmed and complete passenger list no later than 60 days prior to departure. Any changes to that list within 15 days of the trip start date will incur an administrative fee of US$200 per significant change. A significant change is defined as a complete change of route, trekking programme or destination for any individual passenger in the group.

6. Payment Schedule -- Amazon River Cruises

A non-refundable deposit of US$1,000 per person is required to confirm an Amazon river cruise booking. The balance is due 95 days before the departure date. Bookings confirmed 95 days or fewer before departure require full, non-refundable payment upon confirmation. For private charter arrangements, specific deposit structures and payment timelines apply and will be detailed in your individual booking confirmation, which must be agreed in writing before the booking is considered confirmed.

7. Amendments by the Client -- Before Departure

All requests to amend a confirmed booking must be submitted in writing as early as possible. We will make every reasonable effort to accommodate changes to the agreed itinerary. Amendment requests received fewer than 30 days before departure may be constrained by supplier and permit conditions. Any additional costs arising from amendments -- including rebooking fees, new permits and administrative charges -- will be passed on to you at cost. An administrative fee of US$200 per person may apply for significant amendments. No refund will be given for any service, accommodation or activity that is cancelled or unused as a result of a client-requested change. If you are prevented from travelling due to illness, jury service, death of a close family member or a similarly serious unforeseen circumstance, you may request to transfer your booking to another person, subject to the following conditions: the request must be made in writing with supporting documentation; the replacement traveller must be acceptable to Kada Travel; the replacement traveller must agree in full to these terms and conditions; and an administrative fee of US$200 per person applies, plus any charges imposed by suppliers. Please note that airline tickets sometimes carry 100% cancellation fees plus the cost of a new ticket. Inca Trail permits are strictly non-transferable and non-refundable regardless of the reason for transfer.

8. Amendments by the Client -- During the Journey

Our service includes full support on the ground to accommodate reasonable changes you may wish to make during your travels. However, if you decide to cancel guiding services, accommodation, specific restaurants or experiences once the journey is underway, charges will normally apply for any new services arranged and no refunds will be given on cancelled services. Administrative charges will apply for significant itinerary changes during travel. Our 24-hour concierge support extends to emergencies such as medical situations, urgent evacuations, force majeure events and sensitive family matters; this level of out-of-hours support may carry additional charges.

9. Cancellations by the Client

If you cancel a confirmed booking, the following charges apply, calculated from the date on which Kada Travel receives written notice of cancellation: 91 or more days before departure -- deposit forfeited, no further charge; 61 to 90 days before departure -- 50% of the total journey cost; 31 to 60 days before departure -- 75% of the total journey cost; 30 days or fewer before departure -- 100% of the total journey cost. The cancellation policy applies to individual members of a group booking as well as to the group as a whole. Amazon river cruise programmes and remote lodge itineraries may carry specific cancellation terms, which will be set out in your individual booking confirmation. No refund will be given for any services, accommodation or activities unused after the journey has commenced. If during the journey you decide to cancel the remaining trip or change route entirely, no refunds will be given for unused services or accommodation. Inca Trail permits are non-refundable and non-transferable under any circumstances, regardless of the reason for cancellation.

10. Cancellation or Alteration by Kada Travel

In the unlikely event that Kada Travel must cancel or significantly alter your confirmed journey prior to departure, we will notify you at the earliest opportunity. We consider a significant alteration to include: a change of departure date by more than 12 hours, a change of route or destination, or a change to accommodation of a materially lower standard. In such circumstances, we will offer you either a full refund of all monies paid to Kada Travel, or an alternative journey of comparable quality and standard. Where a lower standard of accommodation must be substituted, we will refund the difference in value. Kada Travel is not responsible for any independently arranged costs such as international airfares, visa fees or third-party bookings.

11. Force Majeure

Kada Travel shall not be liable for any failure to perform, or for any cancellation, delay or alteration of a journey caused by circumstances outside our reasonable control. These circumstances include, but are not limited to: acts of any government or public authority; natural disasters, earthquakes, volcanic eruptions or flooding; severe or unusual weather conditions; political instability, civil disturbance, riot or acts of terrorism; pandemic, epidemic or public health emergency declared by a competent authority; industrial disputes, strikes or transport failures; power failure or technical failure of equipment; or any other extraordinary event that could not reasonably have been anticipated or avoided. In such circumstances Kada Travel will make every effort to arrange suitable alternatives; however, refunds of payments already made to third-party suppliers cannot be guaranteed. Under no circumstances will Kada Travel offer refunds for cancellations that result solely from a force majeure event.

12. Price Variations

All prices are based on costs and exchange rates at the time of quotation. Kada Travel reserves the right to pass on unavoidable price increases arising from changes in government-imposed taxes or levies, national park or entrance fees, airline or train tariffs, fuel surcharges, or significant adverse currency fluctuations. You will be notified of any such increase as soon as it comes to our attention. In the event of a price increase exceeding 10% of the total journey cost prior to final payment, you will have the option to cancel the booking with a full refund of all monies paid to Kada Travel. Any price increases on train tickets, airline tickets, boat fares, national park fees or hotel rates occurring between the time of booking and the time payment is made will be passed on to you at cost.

13. Health and Safety

Many of our journeys involve high altitudes, remote locations, river travel, trekking and other physical activities that carry inherent risk. It is your responsibility to disclose any relevant medical condition, physical limitation or dietary requirement to Kada Travel at the time of booking. We strongly recommend consulting your physician before travel, particularly to high-altitude destinations such as Cusco, the Sacred Valley and Puno. Kada Travel reserves the right to decline a booking or exclude a participant from an activity if, in our reasonable judgement, participation would present a risk to the health or safety of that individual or others in the group. Clients are responsible for ensuring they hold valid passports, the correct visas and any required health certificates or vaccinations prior to travel.

14. Liability

Kada Travel acts as travel organiser and, where applicable, as agent for airlines, hotels, lodges, river cruise operators and other suppliers. Our liability is limited to the value of the services we have directly contracted to provide. We are not liable for losses, delays, injury or damage arising from the acts or omissions of independent third-party suppliers, or from circumstances beyond our reasonable control. Nothing in these terms limits our liability for death or personal injury caused by our own negligence, or for any other liability that cannot be excluded or limited under applicable Peruvian law.

15. Governing Law

These terms and conditions are governed by the laws of the Republic of Peru. Any dispute arising from a booking with Kada Travel shall first be addressed through direct negotiation between the parties. Should a resolution not be reached through negotiation, disputes shall be subject to the exclusive jurisdiction of the courts of Lima, Peru.
